Gnome Early Access (Beta) Agreement

Last updated: October 28, 2026

In short. You are getting free, invite-only early access to a pre-release product. It will have bugs, it will change, and data can be lost — keep your own copies. Access does not turn into a paid subscription on its own. Please keep what you see confidential. Disputes go to court in New York, not arbitration.

The parties

This Early Access (Beta) Agreement (this "Agreement") is between Gnome Inc., a Delaware corporation, 1178 Broadway, 3rd Floor #3970, New York, NY 10001 ("Gnome," "we," "us"), and you, the individual accepting it ("you"). By checking "I agree" or by using the early access version of the Gnome service (the "Beta Service"), you agree to this Agreement.

Your access

Access is by invitation only. We grant you a personal, limited, revocable, non-transferable, non-sublicensable right to use the Beta Service for your own evaluation and household use during the early access program. Do not share your account or your invitation.

It is free, and it does not convert

The Beta Service is free during early access. We do not collect a payment method, and there is no automatic renewal. If we later offer paid subscriptions, you will have to separately agree to Gnome's full Terms and Conditions and choose to subscribe. Your early access does not convert into a paid subscription automatically, and we will not charge you without your affirmative consent.

Pre-release software — what to expect

The Beta Service is pre-release and is provided "as is" and "as available," without warranties of any kind, express or implied. In particular:

  • it may contain bugs, errors, and incomplete features;
  • features may change, be added, or be removed at any time;
  • data you enter may be lost, corrupted, or reset;
  • the Beta Service may be slow, interrupted, or suspended at any time, with or without notice; and
  • some features, including property value and market data and paint color features, depend on third-party data providers and may be unavailable, limited, or changed at any time.

Keep your own copies of your closing statements, invoices, photos, and other originals. The Beta Service is not a backup service.

Informational disclaimers

The following apply to the Beta Service, just as they do to the full Service:

  • any estimated value is an automated estimate, not an appraisal;
  • any cost basis figure is an estimate, not tax advice — talk to your own tax advisor;
  • any mortgage rate shown is a published national average, not a quote or an offer of credit;
  • neighborhood statistics are not a valuation of your home;
  • paint and color data is approximate, and on-screen colors are approximations — always confirm against a physical paint sample before buying or using paint; and
  • the Beta Service is not a backup, and any property record shown is not a title or ownership report.

Paint color data, such as hex codes, is provided by PaintDB (paintdb.com) and is based on manufacturer-published specifications. Neither Gnome nor PaintDB guarantees its accuracy. When mortgage rate data is enabled, you agree to be bound by the FRED® API Terms of Use (https://fred.stlouisfed.org/docs/api/terms_of_use.html) and the FRED® legal notices (https://fred.stlouisfed.org/legal/), and you acknowledge that this product uses the FRED® API but is not endorsed or certified by the Federal Reserve Bank of St. Louis.

If property value or market data features are made available during early access, you may use any property record, estimated value, value history, neighborhood statistic, nearby sale, or other market data made available through the Beta Service solely for your personal, non-commercial use within the Beta Service, and you may not copy it, store it outside the Beta Service, redistribute it, or use it commercially; use it for any credit, insurance, employment, or government eligibility decision; use it to create, supplement, or replace a title report, and any estimated value is not an appraisal; use it for any artificial intelligence or machine learning purpose, or scrape, crawl, harvest, or reverse engineer it; or use any other owner's name, address, or loan information; all such data is provided "as is," without warranties of any kind from Gnome or our property data provider, and our property data provider is an intended third-party beneficiary of this paragraph.

Confidentiality

The Beta Service and everything about it that is not public — features, screens, designs, performance, roadmap, pricing plans, and known issues — is Gnome's confidential information. Please do not post screenshots or video, describe unreleased features publicly, or share non-public information about Gnome without our prior written permission (email is fine). This does not apply to information that becomes public through no fault of yours, and it does not restrict your own data.

Feedback

We want your feedback. If you send us ideas, suggestions, or bug reports, you grant Gnome a perpetual, irrevocable, worldwide, royalty-free license to use them for any purpose without any obligation to you. Please do not send us anything you consider confidential or that belongs to someone else.

Acceptable use

You agree not to:

  • scrape, crawl, harvest, or otherwise extract data from the Beta Service;
  • reverse engineer, decompile, or attempt to derive source code, except where the law does not allow that restriction;
  • interfere with the security or integrity of the Beta Service, or attempt unauthorized access;
  • use the Beta Service for any unlawful purpose or in violation of anyone else's rights; or
  • add a property that you do not own and in which you have no legitimate interest.

Privacy

Gnome's Interim Privacy Notice for Early Access Users describes what we collect during early access and how we use it. It applies to you until we post our full Privacy Policy. Please do not upload Social Security numbers or full financial account numbers — redact them before you upload a document.

Term, termination, and your data

  • Either of us may end this Agreement, and your early access, at any time, on notice. Early access ends automatically when you accept Gnome's public Terms and Conditions or when we end the program.
  • You can download your data from your account at any time. If you delete your account, all of your data is permanently deleted and cannot be recovered, so please download anything you want to keep before you delete your account. You may also email privacy@gnomeyourhome.com to ask us to export or delete your data.
  • We will give you at least 14 days' notice before we delete beta data, unless the data is carried over into a regular Gnome account.

Limitation of liability

Because the Beta Service is provided free of charge, and to the fullest extent permitted by law: Gnome's total liability for all claims arising out of or relating to the Beta Service or this Agreement will not exceed $100. Gnome will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost or corrupted data, loss of goodwill, or the cost of substitute services, even if we were advised that those damages were possible. Some states do not allow these limits, so parts of this section may not apply to you.

Governing law and venue — no arbitration

This Agreement is governed by the laws of the State of New York, without regard to its conflict of laws rules. Any dispute arising out of or relating to this Agreement or the Beta Service must be brought exclusively in the state or federal courts located in New York County, New York, and each of us consents to that jurisdiction. There is no arbitration clause and no class action waiver in this Agreement. Gnome's public Terms and Conditions contain an arbitration provision that would apply separately if and when you accept them.

General

This Agreement is the entire agreement between you and Gnome about the Beta Service. We may update it by notice to the email address on your account; if you keep using the Beta Service after the notice period, you accept the update. If a provision is unenforceable, the rest stays in effect. You may not assign this Agreement. Questions: legal@gnomeyourhome.com.

Acceptance

You accept this Agreement by checking the "I agree to the Early Access (Beta) Agreement and the Interim Privacy Notice" box when you create your account.
